Introduction to the Essentials of Constitutional Law

Constitutional law involves several federal statutes, most prominently the Canadian Charter of Rights and Freedoms and the Constitution Act 1867 (U.K), and 1982. Constitutional law also impacts on provincial legislation and case law. The Constitutional law course consists of a survey of constitutional law fundamentals including the rule of law; the Crown and the executive, legislative, and judicial branches of government; and judicial review. The nature of Canadian federalism is explored, along with Aboriginal rights and the rights of individuals under the Canadian Charter of Rights and Freedoms. Included in this research guide are references to important resources to start your research such as Halsbury’s Laws of Canada and the Canadian Encyclopedic Digest; relevant online databases for caselaw and legislative research; journal indexes; and catalogue links to texts on different aspects of constitutional law held on Reserve in the John and Dotsa Bitove Family Law Library.
